Outdoor Pawtraits – Photography Agreement

1. Parties
This agreement is between Outdoor Pawtraits (“the Photographer”) and the undersigned client (“the Client”).

2. Session Type & Package
The Client is booking a pet photography session as discussed and confirmed in writing (email/message) and/or via voucher redemption. The specific package chosen (Mini, Standard, or Premium) determines the session length, number of pets included, travel distance, and number of final edited images. Package details are listed on the Outdoor Pawtraits website and/or voucher at the time of booking.

3. Dogs, Behaviour & Safety
The Client confirms that all animals involved in the session are up to date with vaccinations to the best of their knowledge and are not known to be aggressive. The Client is responsible for handling and controlling their dog(s) at all times during the session. The Photographer reserves the right to stop or cancel a session if a dog’s behaviour is unsafe, overly aggressive, or likely to cause harm to any person, other animals, or property. In such cases, the session fee is non-refundable.

4. Weather & Rescheduling
Outdoor Pawtraits is an outdoor photography service and is therefore weather dependent. If the Photographer believes the weather will negatively affect the session (heavy rain, extreme wind, dangerous conditions, etc.), the Photographer may offer to reschedule. In the event of rescheduling due to weather, the Client’s session fee and voucher (if applicable) will be transferred to a new mutually agreed date. Poor light or overcast conditions that still allow safe shooting do not automatically qualify for rescheduling.

5. Cancellation & No-Show
If the Client needs to cancel or reschedule, they must provide as much notice as possible. Deposits are non-refundable but may be transferred to a new date at the Photographer’s discretion if sufficient notice is given. If the Client fails to attend the session without notice, the session fee and any deposit are forfeited and no re-shoot will be offered.

6. Vouchers
Gift vouchers are valid for the period stated at purchase (usually 12 months from purchase date) unless otherwise agreed in writing. Vouchers are non-refundable but may be transferred to another person with the Photographer’s prior agreement. The voucher must be presented (physically or digitally) when booking and/or on the day of the session. Expired vouchers may be refused or may be honoured at the Photographer’s discretion, potentially with an additional fee if prices have changed.

7. Travel
Each package includes travel within the distance stated on the website (for example, Mini: 10 miles, Standard: 20 miles, Premium: 30 miles – subject to change). Distances are measured from the Photographer’s base near Bishop Auckland, County Durham. Additional mileage beyond the included radius may be charged at a per-mile rate agreed before the session. Any parking fees or location entry fees are the responsibility of the Client unless expressly agreed otherwise.

8. Number of Final Images
The number of fully edited digital images included is determined by the package chosen (e.g., Mini: 3 images, Standard: 7 images, Premium: 15 images – or as updated on the website at the time of booking). The Photographer will select and edit the best images from the session. Unedited images, RAW files, and rejected images are not supplied under any circumstances.

9. Extra Images & Products
If the Client wishes to purchase additional edited images beyond those included in their package, these will be charged at the rate stated on the website or price list at the time of ordering. Printed products, wall art, albums and other physical items are not included unless expressly stated. Prices for add-ons may change over time.

10. Turnaround Time
The Photographer aims to deliver an online proofing gallery within a reasonable timeframe, typically within 2–4 weeks of the session date, but this may vary during busy periods. Premium sessions with “priority editing” will be processed ahead of standard queue where possible. Exact timescales are not guaranteed but delays will be communicated where necessary.

11. Image Style & Artistic Control
The Client acknowledges that they have viewed the Photographer’s portfolio and understand the creative style. The Photographer retains full artistic control over image selection, editing style, and processing. Minor retouching (such as small distractions, light blemishes, or leads that cannot be practically removed on location) may be included at the Photographer’s discretion. Extensive retouching (e.g., major body changes, heavy object removal) may incur an additional fee if requested.

12. Copyright & Usage Rights
All images remain the copyright of Outdoor Pawtraits and the Photographer at all times. The Client is granted a personal, non-commercial licence to print and share the final delivered images for their own use (including on personal social media) provided they do not edit them heavily, apply filters that significantly alter the Photographer’s work, or remove watermarks where used. The Client may not sell, enter into competitions that require full copyright transfer, or use the images for commercial purposes (such as advertising, product promotion, or business branding) without written permission and an additional licence fee.

13. Model Release – Social Media & Portfolio Use
Unless the Client specifically objects in writing below, the Client grants the Photographer permission to use images from the session featuring their dog(s) for portfolio, social media, website, advertising, print samples, competitions, and other marketing purposes. If the Client does not wish images of their dog(s) to be used publicly, they must clearly indicate this below or inform the Photographer in writing before the session and/or image delivery.

14. Limitation of Liability
The Photographer will take all reasonable care with equipment, data handling, and image backup. In the unlikely event of equipment failure, data loss, illness, or any other circumstance beyond the Photographer’s control that prevents the delivery of images, liability shall be limited to rescheduling the session where possible or refunding fees paid (excluding any used vouchers) as a full and final settlement. The Photographer cannot be held liable for situations beyond their control, such as dogs not cooperating, poor behaviour, or weather changes.

15. Data Protection
The Photographer will store the Client’s details (name, contact information, session notes, and signed agreement) securely for business, accounting, and legal purposes. Signed contracts may be retained for up to 6 years. The Photographer will not sell or share the Client’s personal data with third parties except where required by law or for essential service delivery (e.g., print labs, email providers).

16. Agreement
By signing below, the Client confirms that they have read, understood, and agree to the terms of this Outdoor Pawtraits Photography Agreement and the package details discussed at the time of booking. The person signing confirms they are over 18 and authorised to enter into this agreement.
